Canadian terrorist says his religion requires him to kill you and he is being discriminated against if you don't let him
According to The Toronto Star, lawyers for convicted terrorist Momin Khawaja are going to the Supreme Court to argue "that because the definition required the terrorist conduct to be performed for political, religious or ideological reasons, it infringes the Charter right to express religious beliefs and political opinions."

I thought that the Supreme Court cannot rule on foreign Affairs and Security and these cases involve these two areas. Is this judicial activism?
It appears this guy is arguing a violation of his domestic Charter rights which would be in the purview of the SC. But they can also decline to hear cases and this one is so prima facie idiotic, it is bizarre that they agreed to take it.

So let me get this straight. If the Supreme Court rules in his favor, then they are essentially saying that murder (or attempts thereof) is an acceptable expression of religion or political views? Good grief, this could set a horrible precedent. Imagine how many murderers, terrorist or otherwise, can use it as an excuse.

It would seem that the Court would have to sever Charter Rights from Security and Foreign Affairs issues. But it's like the chicken and the egg thing which comes first Charter Rights or National Security.
